General Terms and Conditions for the Conference Centre of the Catholic Academy in Bavaria KSdöR

1. SCOPE

1.1 These terms and conditions apply to all reservation contracts for the rental of rooms as well as all other services provided to the customer in this context by the Conference Centre of the Catholic Academy in Bavaria KSdöR, hereinafter referred to as the Conference Centre. The term reservation contract includes and replaces all related terms such as guest event, reservation, booking.
 

2 CONCLUSION OF THE CONTRACT, CONTRACTING PARTIES, LIMITATION PERIOD

2.1 The contracting parties are the conference centre and the orderer, hereinafter referred to as the customer. The contract is concluded by the Conference Centre's acceptance of the Customer's application. The conference centre is free to confirm the reservation in text form.
 

3 SERVICES, PRICES, PAYMENT, OFFSETTING

3.1 The conference centre is obliged to keep the rooms booked by the client ready and to provide the agreed services.

3.2 The Client shall be obliged to pay for the services ordered and for any other services used by the Client at the agreed or applicable prices of the Meeting Centre.

3.3 In the event of a subsequent reduction in the booked services by the Client, the Conference Centre shall be entitled to recalculate the prices for the remaining booked rooms and other services.

3.4 Invoices of the conference centre are payable immediately upon receipt of the invoice without deduction.
 

4 WITHDRAWAL BY THE CUSTOMER (CANCELLATION / CANCELLATION PAYMENT) NON-UTILISATION OF SERVICES

4.1 Cancellation of the contract by the customer is possible in whole or in part, free of charge, up to 8 weeks before arrival or the start of the event.

4.2 The withdrawal must be received in writing (email/FAX/letter) in due time.

4.3 Default payment for guest events / conferences

If the cancellation deadlines (Para. 4.1) are not met or services are not used at all, the conference centre will demand compensation as follows:

up to 8 weeks before arrival: free of charge

until 2 weeks before arrival: 50% of all booked services

from the 13th day before arrival: 60% of all booked services

A cost-free withdrawal from the contract in whole or in part (pursuant to para. 4.1) on the grounds of a lack of suitability of the event room (e.g. due to applicable distance regulations) is not possible if the customer was already aware of these at the time the contract was concluded. The customer shall not be entitled to change the conference room free of charge or for an additional charge.
 

4.4 Overnight guests/ individual bookings

Guests without a written contract may cancel their booking. The cancellation must be received by the conference centre by 6.00 p.m. on the day before the planned arrival (para. 4.2). After this deadline, the conference centre will demand compensation for the first night in the amount of 80% of all booked services. The client is free to prove that the aforementioned claim has not arisen or has not arisen in the amount demanded.
 

5 WITHDRAWAL BY THE CONFERENCE CENTRE

5.1 The conference centre is entitled - as is the client - to cancel the contract in whole or in part up to 8 weeks before arrival or the start of the event. Furthermore, the conference centre is entitled to withdraw from the contract extraordinarily for an objectively justified reason, in particular if:

force majeure or other circumstances for which the conference centre is not responsible make the fulfilment of the contract impossible (e.g. operating prohibitions by authorities)
rooms or rooms are culpably booked with misleading or false information or concealment of material facts; material facts may be the identity of the customer, the ability to pay or the purpose of the stay
the purpose or occasion of the stay or the organiser contradict the basic statements of the Christian faith, the conference centre is entitled to cancel the contract.

5.2 The justified withdrawal of the conference centre does not justify a claim for damages on the part of the customer.
 

6 ROOM/ROOM PROVISION, HANDOVER AND RETURN

6.1 The Client shall not acquire any claim to the provision of specific rooms, unless this has been expressly agreed.

6.2 Booked rooms are available to the customer from 3.00 p.m. on the day of arrival until 10.30 a.m. on the day of departure.

6.3 Booked seminar/event rooms are available to the customer in accordance with the contract.
 

7 FINAL PROVISIONS

7.1 Amendments and supplements to the contract, the application acceptance or these General Terms and Conditions shall be made in text form. Unilateral amendments or supplements by the customer are invalid.

7.2 Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
